Acceptable Use Policy (AUP)

This Acceptable Use Policy ("AUP") outlines rules and guidelines for using services provided by ElightNodes ("we," "our," or "us"). All clients ("you," "users," or "customers") must comply with this policy. Use of our services constitutes agreement to this AUP and our other policies.

Violating this policy may result in warnings, service suspension, or account termination without refund.

1. General Conduct

You agree to use our services in a manner that is:

  • Lawful,
  • Ethical,
  • And does not interfere with the rights of others.

You may not use ElightNodes services for any of the following:

  • Hosting or distributing malware, viruses, or backdoors
  • Running phishing sites or fake login pages
  • Launching Denial-of-Service (DoS/DDoS) attacks
  • Running botnets or C2 infrastructures
  • Distributing copyrighted content without authorization
  • Promoting terrorism, violence, or hate speech
  • Sending unsolicited bulk emails (spam)
  • IP spoofing or network packet manipulation

2. Resource Fair Usage

All services are governed by our Fair Use Policy. While we aim to offer generous limits and flexibility, resources must be used responsibly to ensure server stability.

2.1 CPU Usage (Virtual Servers)

  • CPU cores on VPS/VDS plans are shared and burstable unless otherwise stated.
  • Sustained high CPU use (100% for long periods) may result in throttling or investigation.
  • Dedicated core allocation varies by CPU model and RAM amount — refer to our Fair Use chart for reference.
  • If your usage negatively impacts other clients, your VM may be capped or suspended.

2.2 CPU Usage (Web Hosting)

  • LVE limits apply per site.
  • Excessive use (e.g., >25% of 1 full core) may lead to adjusted limits or temporary restrictions.

2.3 Cryptocurrency Projects

  • Cryptocurrency and blockchain projects that cause constant high CPU/disk usage (e.g., Monero, Qilibirum) are not allowed on shared infrastructure.
  • Projects like Flux may be allowed, subject to prior approval.
  • You may run any cryptocurrency project on dedicated servers, provided it does not excessively wear out disks.
  • No refunds will be issued for suspended VPS services due to crypto misuse.

2.4 Bandwidth Usage

  • "Unmetered" plans are subject to reasonable use. Sustained usage beyond 30–50TB/month or constant 10 Gbps may result in review.
  • Sustained usage above 100–200 Mbps (95th percentile) may be limited or flagged.

2.5 I/O Usage

  • I/O is not strictly capped, but we prohibit applications that damage SSDs (e.g., Chia plotting).
  • Dedicated and VPS clients must avoid activities that degrade disk health for others.

3. Network Abuse

  • You must not:
    • Attempt unauthorized access to systems or networks
    • Run port scanners, brute-force scripts, or exploit kits
    • Obscure traffic via proxies or VPNs for illegal purposes
    • Relay spam or perform open relay abuse
  • TOR exit nodes may be allowed with prior approval and IP allocation review.

4. Spam and Email Policy

  • Port 25 is blocked by default on VPS/VDS.
  • You may use external SMTP services (e.g., Amazon SES).
  • Sending bulk or unsolicited email is prohibited.
  • If you're found spamming, your service may be terminated and a $25 IP cleaning fee charged.

5. Fraudulent Activity and Identity

  • Submitting fake names, false addresses, or misleading account details is strictly prohibited.
  • Accounts suspected of fraud may be suspended or terminated immediately.
  • Chargebacks are treated as fraud. We reserve the right to provide full logs and data to payment processors to contest chargebacks.

6. Abuse Handling and Response Time

  • If we receive an abuse complaint (e.g., DMCA, spam, hacking attempts):
  • You must respond within 24 hours of notification.
  • Failure to respond may result in service suspension or termination after 7 days.
  • For serious violations, immediate action may be taken.

7. Legal Compliance

  • You are responsible for ensuring your use complies with:
    • Indian laws (as we are based in India),
    • And the laws of the country where your server is located (e.g., Germany, USA).
  • We respond to valid legal requests, including subpoenas and copyright notices (DMCA or EUCD equivalents).

8. Data Loss and Backups

We are not responsible for data loss. Customers are expected to maintain external backups even if our platform provides optional backups.

9. Policy Enforcement

  • We reserve the right to:
    • Monitor resource usage
    • Investigate abuse
    • Throttle or suspend offending services
    • Terminate accounts in severe or repeated cases
  • We may refuse service to individuals or organizations that pose a risk to our infrastructure or reputation.

10. Changes to This Policy

This Acceptable Use Policy may be updated from time to time. It is your responsibility to stay informed of any changes. We may notify users of major changes via email or dashboard announcements.
